DMCA Policy

1. Introduction

DegreeCalc ("we," "our," or "us") respects the intellectual property rights of others and expects our users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 (the "DMCA"), Title 17, United States Code, Section 512(c)(2), we have designated an agent to receive notifications of claimed copyright infringement on our website at degreecalc.com.

This DMCA Policy outlines our procedures for responding to notices of alleged copyright infringement in compliance with the DMCA and other applicable intellectual property laws. We take copyright infringement seriously and will respond promptly to notices of alleged infringement that comply with applicable law and are properly submitted to our designated agent.

2. Reporting Copyright Infringement

If you believe that content available on or through our website infringes your copyright, you may submit a written DMCA takedown notice to our designated agent. Your notice must include substantially the following information as required by the DMCA:

  1. Identification of the copyrighted work. A description of the copyrighted work that you claim has been infringed, or if multiple copyrighted works are covered by a single notification, a representative list of such works.   4. Statement of good faith belief. A statement that you have a good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  5. Statement of accuracy. A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
  6. Physical or electronic signature. A physical or electronic signature of the copyright owner or a person authorized to act on behalf of the copyright owner.

4. Processing of Takedown Notices

Upon receiving a valid DMCA takedown notice that complies with the requirements set forth in Section 2 above, we will take the following actions:

  • Acknowledgment. We will acknowledge receipt of your notice and begin our review process.
  • Investigation. We will review the notice and investigate the claimed infringement in a timely manner.
  • Removal or disabling of access. If we determine that the notice is valid and complete, we will remove or disable access to the allegedly infringing material expeditiously.
  • Notification to the alleged infringer. We will make a good faith effort to notify the person or entity that provided the allegedly infringing content, informing them that the material has been removed or disabled and providing them with information about their right to submit a counter-notification.

Please note that under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material or activity is infringing may be subject to liability for damages, including costs and attorneys' fees, incurred by the alleged infringer, the copyright owner, or the service provider.

5. Counter-Notification

If you believe that material you posted on our website was removed or disabled as a result of a mistake or misidentification, you may submit a counter-notification to our designated agent. Your counter-notification must include substantially the following:

  1. Identification of the removed material. Identification of the material that was removed or to which access was disabled, and the location at which the material appeared before it was removed or access was disabled.
  2. Statement under penalty of perjury. A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of a mistake or misidentification of the material to be removed or disabled.
  3. Your contact information. Your name, mailing address, telephone number, and email address.
  4. Consent to jurisdiction. A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located, or if your address is outside of the United States, for any judicial district in which the service provider may be found, and that you will accept service of process from the person who provided the original DMCA notification or an agent of such person.
  5. Physical or electronic signature. Your physical or electronic signature.

6. Restoration of Removed Material

Upon receiving a valid counter-notification, we will forward it to the original complainant. If the original complainant does not file a court action seeking to restrain the allegedly infringing activity within ten (10) business days of receiving the counter-notification, we may, at our discretion, restore the removed material or cease disabling access to it within ten (10) to fourteen (14) business days after receipt of the counter-notification, unless we first receive notice from the complainant that they have filed such a court action.

7. Repeat Infringers

In accordance with the DMCA and other applicable law, DegreeCalc has adopted a policy of terminating, in appropriate circumstances and at our sole discretion, access for users or contributors who are deemed to be repeat infringers. DegreeCalc may also, at its sole discretion, limit access to the website or terminate access for any user who infringes the intellectual property rights of others, whether or not there is any repeat infringement.

8. Modifications to Content

DegreeCalc reserves the right to modify, remove, or disable access to any content on our website at any time, with or without notice, for any reason or no reason at all. This includes content that we believe, in our sole discretion, may infringe the intellectual property rights of others, violate our terms of service, or otherwise be inappropriate.

9. Good Faith and Fair Use

Before submitting a DMCA takedown notice, please consider whether the use of the copyrighted material at issue may constitute "fair use" under Section 107 of the Copyright Act. Fair use permits limited use of copyrighted material without the copyright owner's permission for purposes such as criticism, comment, news reporting, teaching, scholarship, and research.
